Citation
Description The Rome I Regulation was adopted in an area that was already regulated between Member States, through the Rome Convention. Clarification of the relationship with that Convention is therefore necessary. This topic respresents the main topic of this chapter. As the Rome Convention did not cease to exist with the adoption of the Regulation Rome I, the chapter defines its residual territorial scope of application. Particular attention is paid to the position of Denmark and the possible application of the Rome Convention and the Rome I Regulation in relation to that country. Commentary to the Article 25 addresses the following areas of concern: dealing with the conflict between the Rome I Regulation and international treaties concluded with third states under the rules laid down in the Rome I Regulation, under the TFEU, under another international treaty (the Hague Convention), under a treaty concluded by Member States with third states after 17 June 2009 and also in relation to treaties concluded exclusively between Member States.
